Biden-Era Policies Undermine State Protections Against Abortion

When the U.S. Supreme Court overturned the infamous Roe v. Wade decision, in Dobbs vs. Jackson Women’s Health Organization, 597 U.S. 215 (2022), Justice Samuel Alito, writing for the majority, said, “We now overrule those decisions [Roe and Casey] and return that authority to the people and their elected representatives.”

Following the Dobbs ruling, several Republicans — including President Trump — said abortion was now in the hands of the states. “The states will determine . . .  whatever they decide must be the law of the state,” Trump insisted.

While I disagree with the notion that abortion should be regulated solely to the states, the reality is that most anti-abortion protections have historically been advanced at the state level.
