DALLAS (WBAP/KLIF News) – A Dallas County judge has denied a request by attorneys for former Balch Springs police officer Roy Oliver for a change of venue in his murder trial.
Oliver will be tried for the 2017 murder of 15-year-old Jordan Edwards.
His attorneys argued Tuesday that a trial in Dallas County would be prejudiced because of extensive media coverage of the case.
State District Judge Brandon Birmingham disagreed.
Edwards and his brothers were driving away from a party when investigators said Oliver shot at the car killing Edwards, who was unarmed.
Police had been called to the party based on reports of underage drinking and drugs. None were found.
The department initially said the car Edwards was riding in was backing up towards officers when Oliver allegedly fired the fatal shot.
After reviewing surveillance video from that night, Balch Springs Police Chief Johnathan Haber said the car was actually driving away from the officers.
Oliver was fired three days after the shooting.
The trial is scheduled for next month. Oliver is also facing several charges of aggravated assault by a public servant.
