ELLIS COUNTY (WBAP/KLIF News) – Ellis County Sheriff Johnny Brown resigned Wednesday, the same day he pleaded guilty to a misdemeanor assault charge.

The two-term sheriff, who has served since 2009, surrendered his Texas Peace Officer License after he admitted to his involvement in a brawl at  Midlothian Whataburger on New Year’s Day.

Two men told Midlothian police that Brown’s brother Bobby allegedly started the fight and that the former sheriff joined the brawl in his defense.

Brown issued a statement addressing his resignation. It read in part:

“I offer my most sincere apologies to any and all who I may have hurt or disappointed. As can be seen by the actions I have taken to make things right today, I care more for the office I held, my coworkers and fellow public officials, the citizens of Ellis County, and respect for the law than to continue a battle that consumes time, money and detracts from the mission of protecting and serving.”

Brown agreed to a plea deal of a one-day sentence and a $500 fine. The case against his brother is still working its way through the court system.

Ellis County Judge Carol Bush also issued a statement that said a commissioner’s court meeting will convene soon to find a replacement for Brown.
