WASHINGTON D.C. (WBAP/KLIF) – The U.S. Supreme Court is considering arguments over Texas’ controversial abortion law.
The high court heard arguments Monday in cases against Texas by the Federal government and abortion providers. It could be weeks, or longer, before a ruling comes down.
The ‘Texas Heartbeat Law’ bans abortion once a fetal heartbeat is detected. The issue in front of the Supreme court though, is over how the law is enforced. The State pointed out that private businesses can enforce the law by suing abortion providers. It doesn’t include any action from the state. The Federal government takes issue with what it calls “an enforcement scheme.”
Attorney General Ken Paxton defended the law in the U.S. Supreme Court.
“The Biden Administration does not have the power to sue a state, such as Texas, just because it disagrees with a state law that protects the unborn,” Attorney General Paxton said. “This attempted federal overreach lacks jurisdiction, and I will oppose the federal government’s efforts to deprive Texans of the right to govern themselves. I will always fight for lives of the unborn, and this law puts our state in the forefront of protecting those without a voice.”
The Supreme Court is expected to address whether the federal courts have jurisdiction over the cases.
