Dallas County Grand Jury to Decide Fate of Elderly Man Charged For Hitting, Killing 12-year-old with Car

CARROLLTON (WBAP/KLIF)- A Dallas County Grand Jury will determine if a man should be charged with criminally negligent homicide for a crash that reportedly killed a young boy in Carrollton. Carrollton police say 78-year-old Andrew Hewett was driving a van that hit and killed 12-year-old Victor Garcia days before Christmas. Jole DeVito with the Carrollton Police Department said Garcia was walking on the sidewalk in the 1400 block of S. Josey shortly before 1:00 p.m. with his mother and a seven-year-old relative when Hewett drove off the roadway, hitting the boy. “Our investigation shows no indication that he tried to leave the scene he did stay and has been cooperative with the investigation,” said DeVito. She said Hewett told investigators he swerved into the sidewalk to avoid another vehicle that had stopped unexpectedly in front of him. The grand jury will determine if the criminally negligent charge is appropriate and The Texas Department of State Health Services Medical Advisory Board will decide whether Hewett is able to safely operate a motor vehicle in the future. “He’s an 78-year-old man with failing health we are asking the state to consider revoking his driver license but in the meantime he said he has no intention of driving again,” said DeVito.
