DALLAS (WBAP/KLIF)- A visiting judge in Dallas County has ruled Judge Tammy Kemp cannot preside over the Dallas County District Attorney John Cruezot’s Contempt of Court hearing.

The decision was made because of Kemp’s bias in the case. “When the business of judging becomes personal the judge needs to walk away,” said Attorney Brian Wice representing Cruezot. “She had a mindset long before they even walked back into chambers about Cruezot,” he said.

Kemp called the hearing during the murder trial for former Dallas Officer Amber Guyger. She said he violated a gag order when doing a TV interview the night before the trial.

Wice said Cruezot didn’t violate the gag order and called gag orders unconstitutional.

“The gag order does not prohibit John Cruezot from giving an interview or discussing the Guyger case…he cannot violate rule 3.07 of the code of professional comment which says a lawyer cannot make an extrajudicial statement, that means me out here with you guys,” he said in an interview outside the courtroom.

Cruezot has recused himself from the case. The next hearing is yet to be determined, a special prosecutor will now oversee the case.
