Guyger’s Defense Speaks on Outcome, Possible Appeal and Hug

DALLAS (WBAP/KLIF) – Amber Guyger’s defense says, all things considered, the 10 year prison sentence given to Guyger for the shooting death of Botham Jean was a good outcome.

Attorney Toby Shook says a murder conviction gives the jury a wide range to consider.

“The publicity this case received, the intensity and the hard feelings going on, the jury is not oblivious to that,” Shook said.

The defense though is not saying yet whether they will appeal the decision. There is a 30 day window.

Guyger was sentenced to 10 years in prison on the guilty murder conviction Thursday. She says she mistook Jean’s apartment for her own when she shot him last September thinking he was an intruder.

During a victim impact statement, Botham Jean’s brother Brandt asked Judge Tammy Kemp if he could hug Guyger after saying he loved her and forgives her.

“She started shaking and when he said he wanted to hug her there was that pause,” Shook said. “She started nodding her head vigorously up and down and saying ‘Yes, yes, yes ,yes.'”

Shook, who has been a prosecutor and defense attorney for many years, says that was the most amazing thing he has experienced in a courtroom.
