Judge to Give Final say on Fort Worth City Leaders to be Questioned in case against Former Police Chief

FORT WORTH (WBAP/KLIF)- A Dallas judge will decide when and if Fort Worth City leaders will be questioned and present documents in the case against former Police Chief Joel Fitzgerald.

At a hearing Wednesday morning City representatives and Fitzgerald and Attorney Stephen Kennedy went back and forth about whether or not the city should reveal documents that were allegedly deleted or altered to cover up information about Fitzgerald’s termination.

The city initially appealed this request saying dates set for deposition were inconvenient and needed more time to fish out all the documents.

Fitzgerald’s attorney Stephen Kennedy says they’re stalling and the documents will help clear Fitzgerald’s name.

Kennedy says the Texas Workforce Commission already investigated that Fitzgerald didn’t do anything wrong at a police event in Washington for him to get fired.

“He’s been applying for numerous jobs across the country and no one will accept him because the city of Fort Worth ruined his reputation when they said they terminated him with cause,” Kennedy said. “This will affect him for a very long time,” he said.

Kennedy said if handed over,  they have a forensic expert ready to look through digital data to confirm any altered documents in any effort to set the record straight. “We are here to get him reinstated, among other things,” said Kennedy.

After the hearing Kennedy says he has a lot of confidence in the Texas Judiciary system. “Today reinforces my belief that our Judiciary system is fair and judges work very hard. I have confidence in our judges to come up with fair and reasonable results,” he said.
