
FORT WORTH (WBAP/KLIF)- The City of Fort Worth will meet with a district judge Wednesday after appealing an order to have witnesses for questioning.
Associate Judge Monica Purdy ordered city leaders to be questioned and show documents the city allegedly hid in the case against former police chief Joel Fitzgerald.
A motion filed by Fitzgerald’s attorney, Stephen Kennedy states he was fired just an hour before a scheduled meeting with FBI about corruption in city hall and had a statement from a city employee claiming the city destroyed digital data.
Kennedy claims the city is stalling by appealing Judge Purdy’s orders, because she’s an associate judge. “They are stalling because the information is harmful to their case,” said Kennedy.
Kennedy said deposition was scheduled for Wednesday, but it’ll now be up to District Judge Gena Slaughter to decide if it will happen and when. “The city has the burden to demonstrate that Judge Purdy’s order is unreasonable,” said Kennedy. “It is Plaintiff’s [Fitzgerald] contention that Judge Purdy’s Orders were fair and reasonable. The City clearly disagrees and wants to continue to stall. Dr. Fitzgerald will pursue the matter with vigor,” he said.
