DALLAS (WBAP/KLIF) – A motion was filed Monday to move the murder trial of former Dallas Police Officer Amber Guyger out of Dallas County.
According to Police, Guyger shot and killed Botham Jean in his Dallas apartment last year after mistaking his unit for her own. Guyger’s lawyers claim their client wouldn’t get a fair trial in Dallas County.
Dallas Criminal Attorney Barry Sorrels is not associated with the case but said a change of venue request typically deals with the nature of the publicity a case has received.
“It’s not the amount of publicity but the nature of the publicity,” said Sorrels. “Has it been so unfair and inflammatory that the average juror would be negatively influenced by that?”
If a change of venue is granted, all attorneys can choose a location or the judge can decide. Adjacent counties are acceptable but another location may be chosen.
A pre-trial hearing with evidence to support the request is expected.
