Local Family Fights for their Daughter to stay on Life Support

FORT WORTH (WBAP/KLIF)- UPDATE: Parent’s of 9-year-old Payton Summons returned to court Monday for another hearing to determine if their daughter will be removed from life support. A Tarrant County judge ruled to extend the Temporary Restraining Order until October 22nd at 6pm. At the hearing the family’s attorneys asked to extend the TPO so the family can have time to “exhaust all options”. They asked the court to mandate a second opinion on her condition and are still hoping to find a hospital that will accept Payton under these conditions. Under Texas Law, a person is considered dead if that person suffers an irreversible loss of all brain function. Doctor’s are claiming because she is considered ‘dead’, she should be removed from her ventilator, however, Payton’s parents say she still has a chance to live. Laura Copeland with Cook Children’s Medical Center says they have asked 28 facilities around the country and says none of them will accept her because she is considered dead by the state of Texas. But the family’s attorney says they might have 3 out of state facilities willing to take Payton.

 

 

A fight between medical staff and a Fort Worth family to keep their daughter on life support continues.  Doctors at Cook Children’s Hospital declared Payton Summons brain dead.  They argued to remove her from life support but her parents are praying for her recovery.  The family returned to court on Friday.  A Tarrant County judge said the family needed a third party to represent her.  The family’s attorney Justin Moore, said another day that Payton is alive is a good thing.  On Monday, a judge issued a temporary restraining order against doctors to allow her to stay on life support for a little longer.  They will meet again Wednesday to possibly come to a decision on her fate.
