FORT WORTH (WBAP/KLIF News) – The sole survivor of the BNSF Railway train crash in the Panhandle this summer is suing the company for $1 million in damages.
Derek Schilling, a former locomotive engineer, filed a lawsuit in Tarrant County last week.
Schilling jumped from the train before the collision, which killed three of his coworkers.
The train left Wellington, Kansas on the morning June 28 and was travelling through North Texas before it crashed near the town of Panhandle, northeast of Amarillo.
His lawsuit claims that a train headed eastbound disregarded at least two signals, including a stop signal, seconds before the collision.
The National Transportation Safety Board is still investigating the crash; however, their preliminary report confirmed the eastbound train missed a stop signal.
The company issued a statement saying they plan on working with Schilling to help in his recovery, which includes financial support for his medical care.
