DALLAS (WBAP/KLIF News) – After being granted a last minute stay of execution in March, a North Texas man convicted of murdering his two daughters while his ex-wife listened on the phone is expected in a courtroom on Monday morning.
John Battaglia’s attorney will ask a judge to let his client live. He’ll argue that his client is mentally incompetent.
In August, Battaglia told WFAA-TV he never got a fair trial. “My story is that the Dallas DA’s Office and some lawyers and judges in Dallas are trying to kill me to cover up their crime,” said Battaglia.
If he is ruled competent, he’ll be executed December 7th.
