DALLAS (WBAP/KLIF News) – After two days in court, the pending execution for a former Dallas accountant who shot and killed his two daughters 15 years ago now rests in the hands of a judge.
John Battaglia, 61, has been in court this week so a judge could decide if he has enough rational understanding of why he’s being executed.
By Texas law, a death row inmate must show rational understanding to be deemed mentally competent for execution.
Four doctors testified in the hearing. Three of them said Battaglia is not fit to be executed due to a diagnosis of delusional disorder.
The fourth believes he’s fine, aligning with the prosecution’s argument that he’s an intelligent man who studied case law while in prison and knows what he’s doing.
