‘GAYEST Congress In History’ Could Challenge Trump’s Policies

The Congressional Equality Caucus declared Thursday that “The 120th Congress will officially be the GAYEST Congress in history! (that we know of)” after the November 3 midterm elections. Equality PAC, an organization affiliated with the caucus, projected a record 17 openly LGBTQ lawmakers in the incoming Congress.

The American people have made their voices heard.

The announcement follows Democratic victories giving the party control of both chambers and raises questions about the future of federal “transgender” policy. The new majority could revive the Equality Act and challenge President Donald Trump’s executive actions recognizing biological sex, although Senate rules and the presidential veto remain obstacles.

Where The Record Figure Comes From

The Equality Caucus’ November 5 statement called the incoming Congress the “GAYEST Congress in history.” Equality PAC projected on November 3 that election results could produce 17 openly LGBTQ lawmakers in the 120th Congress: 15 House members and two senators. That total remains preliminary as election results and the incoming membership are finalized.

The Pew Research Center counted 13 openly LGBTQ voting lawmakers when the current Congress began in January 2025. A later special election and subsequent departures make comparisons with the current membership dependent on the date used.

Returning members include U.S. Rep. Sarah McBride (D-Delaware), Congress’ first openly “transgender” member, and U.S. Rep. Mark Takano (D-California), who chairs the Equality Caucus. U.S. Sen. Tammy Baldwin (D-Wisconsin) remains in office, while U.S. Rep. Chris Pappas (D-New Hampshire) won election to the Senate. California state Sen. Scott Wiener also emerged as the winner in the race to succeed retiring U.S. Rep. Nancy Pelosi (D-California) after his opponent conceded Wednesday, per The San Francisco Standard.

Equality Act Could Return To Center Stage

The Congressional Equality Caucus states that its mission is to advance protections involving “sexual orientation, gender identity and expression, or sex characteristics (including intersex traits).” Its allied Equality PAC says it supports candidates who will help pass the Equality Act.

Takano introduced the Equality Act, H.R. 15, on April 29, 2025. The bill would amend federal civil rights statutes to address discrimination on the basis of sex, sexual orientation, and gender identity, including provisions affecting employment, housing, education, and public accommodations. Supporters describe it as an expansion of civil rights protections; opponents have raised concerns about potential conflicts with sex-specific facilities and religious-liberty protections.

Conflict With White House Policy

Trump’s January 20, 2025, executive order instructs federal agencies to recognize two biological sexes and apply that distinction in federal documents and enforcement of sex-based protections.

Congressional Democrats could hold hearings, introduce legislation, and pursue agency oversight after taking office in January. But most contested Senate bills require 60 votes to end debate under the chamber’s rules. Trump could also veto legislation that reaches his desk, subject to a two-thirds override in each chamber.

The Debate Has Already Reached Capitol Hill

In November 2024, The Dallas Express reported on U.S. Rep. Nancy Mace’s (R-South Carolina) effort to require people to use Capitol bathrooms corresponding to their biological sex before McBride took office. The dispute foreshadowed policy clashes between lawmakers over single-sex spaces.
