The Department of Health and Human Services used a Halloween-themed warning Friday to place sex-rejecting procedures on children among the Make America Healthy Again movement’s “worst nightmares,” as the Trump administration announced another federal rule addressing gender dysphoria and disability protections.
The October 30 post from HHS’ official X account featured an operating-room image with the words, “A haunted house but it’s allowing sex-rejecting procedures on children.”

Other images targeted ultra-processed foods, sedentary indoor lifestyles, and microplastics in drinking water.
“A haunted house filled with MAHA’s worst nightmares!” the agency wrote, adding, “Don’t be scared, @POTUS and @SecKennedy are fixing it all.”
The message followed months of federal action targeting child mutilation, questionable insurance billing, and hospital accountability.
HHS Finalizes New Disability Rule
On Friday, HHS’ Office for Civil Rights announced a final rule clarifying that gender dysphoria not resulting from physical impairments does not qualify as a disability under Section 504 of the Rehabilitation Act of 1973.
The rule applies to programs and activities receiving HHS funding and incorporates exclusions that Congress established under federal disability law.
“My uncle Ted Kennedy was the primary author of the Americans with Disabilities Act and the 1978 amendments that strengthened the Rehabilitation Act. The Biden-era pronouncements that indicated gender dysphoria may be a disability served the commercial interests of a predatory, multi-billion-dollar industry and betrayed the original intention of those laws,” HHS Secretary Robert F. Kennedy Jr. said in the department’s October 30 announcement, adding, “The Trump Administration will continue to bring transparency, accountability, and fidelity to the law back to federal policymaking.”
The rule will appear in the Federal Register on November 3 and take effect 60 days after publication.
Federal Funding Restrictions And Hospital Accountability
In August, the Centers for Medicare & Medicaid Services finalized a separate rule ending federal Medicaid and Children’s Health Insurance Program funding for specified sex-rejecting procedures involving minors.
The restriction took effect October 13 and covers certain hormone inhibitors, cross-sex hormones, and “sex-alteration” surgeries. The rule preserves mental-health coverage and provides a limited transition period for some existing hormone treatments.
As previously covered by The Dallas Express, President Donald Trump characterized the interventions as causing “unthinkable and irreversible harm” in his August 11 Truth Social announcement.
The administration has also pursued restrictions directly affecting hospitals.
In December 2025, CMS proposed prohibiting hospitals participating in Medicare and Medicaid from performing specified sex-rejecting procedures on children younger than 18. That proposal remains distinct from the finalized funding restrictions, and the available record does not establish that CMS has finalized the hospital-wide prohibition.
On October 14, HHS demanded further answers from medical organizations, including the American Medical Association and the World Professional Association for Transgender Health, about their support for such procedures and the evidence behind their recommendations.
Texas Hospitals Face Greater Scrutiny
Texas has already taken significant steps to restrict child “sex-alteration” procedures.
Senate Bill 14, which took effect September 1, 2023, prohibits specified medical interventions for minors, subject to statutory exceptions. The Texas Supreme Court upheld the law in 2024.
Texas Children’s Hospital has faced additional enforcement action.
As The Dallas Express covered October 26, the Houston hospital opened a detransition clinic under a $10 million settlement with Texas Attorney General Ken Paxton’s office involving allegations of improper billing for “sex-altering” treatments.
The agreement requires Texas Children’s to provide qualifying detransition-related care without charging patients for five years, restrict covered medical interventions, and impose additional compliance requirements.
Meanwhile, federal prosecutors in North Texas helped secure a September agreement requiring Mount Sinai Health System to end specified sex-rejecting interventions for minors. The agreement also directed the New York health system to dedicate $2 million toward care for individuals experiencing harmful effects from earlier interventions.
Questions Remain Over Medical Billing
The administration has also examined the financial practices surrounding pediatric “sex-altering” interventions.
In August, The Dallas Express covered an HHS-commissioned report identifying approximately $50 million in insurance claims involving hormone inhibitors that providers billed under an unspecified endocrine-disorder code without certain accompanying diagnoses.
HHS raised concerns that such coding practices could obscure the purposes of treatments and warrant further investigation.
The October 30 Halloween message brought these developments into a broader public-health campaign. Beyond the seasonal imagery, the administration’s actions raise consequential questions about federal funding, the responsibilities of hospitals, and whether additional nationwide restrictions on child mutilation surgeries will become final.
