Washington keeps investigating itself.
Congress holds hearings. Inspectors general issue reports. Special counsels spend years reviewing records. Agencies produce millions of pages. Lawmakers make criminal referrals. Yet many of the government controversies that have consumed public attention for years end without criminal punishment for the senior officials whose decisions drew scrutiny.
The pattern has returned to the forefront as federal investigators revisit pandemic-era decisions, government pressure on social-media moderation and debanking, while the Justice Department has released millions of pages tied to Jeffrey Epstein.
The Office of the Comptroller of the Currency added another example Wednesday. After reviewing nearly 100,000 complaints and about 420,000 pages from nine major banks, the agency concluded that all nine maintained policies between 2020 and September 2025 that could deny or limit financial services because of political or religious beliefs or lawful business activity. The Consumer Financial Protection Bureau immediately opened a separate investigation into possible violations of federal consumer law.
That finding may eventually produce enforcement actions. It also raises a larger question that follows investigation after investigation: What does accountability mean when the public receives a report, but senior decisionmakers face no criminal punishment?
Congress Can Investigate, But It Cannot Prosecute
The answer begins with a constitutional limitation that often gets lost during televised hearings.
Congress can compel testimony, issue subpoenas, expose misconduct and refer possible crimes to the Department of Justice. Congress cannot prosecute federal crimes itself. The Congressional Research Service states that the executive branch retains prosecutorial authority and that a congressional criminal referral does not force DOJ to bring a case.
That gap has practical consequences. A 2023 CRS review found that, since 2008, the House had held 10 people in criminal contempt of Congress and DOJ had sought indictments in only two of those cases. Presidential administrations from both parties have also resisted prosecuting executive branch officials who withheld information under presidential direction or assertions of executive privilege.
Operation Fast and Furious showed the problem more than a decade ago. The House voted 255-67 in 2012 to hold then-Attorney General Eric Holder in contempt over subpoenaed documents connected to the failed gunwalking operation. DOJ did not prosecute Holder. A federal court later forced the department to surrender additional records, but the contempt vote itself produced no prison sentence for the attorney general.
COVID Produced Hearings, Millions Of Pages And A Pardon
The pandemic investigations provide a more recent example.
The House Select Subcommittee on the Coronavirus Pandemic spent two years conducting more than 30 transcribed interviews and depositions, holding 25 hearings and meetings and reviewing more than one million pages of documents before releasing a 520-page final report in December 2024.
The investigation continued after the report. On August 6, 2026, Republicans on the Senate Homeland Security and Governmental Affairs Committee voted 8-5 to advance a contempt resolution against Dr. Anthony Fauci after he invoked the Fifth Amendment during subpoenaed testimony, as The Dallas Express reported at the time. Ranking Member Gary Peters (D-Michigan) argued that the resolution lacked a legal basis and threatened constitutional protections.
The Dallas Express covered that confrontation in August. Former President Joe Biden had already granted Fauci a full and unconditional pardon covering possible federal offenses dating back to 2014. A pardon does not establish guilt, and Biden said his preemptive pardons should not imply wrongdoing. It can, however, foreclose federal prosecution for conduct within its scope.
Censorship Findings Changed Policy, Not Prison Rosters
Congressional investigations also produced documented admissions about government pressure on social media companies.
The House Select Subcommittee on the Weaponization of the Federal Government released a final report totaling more than 17,000 pages after conducting 99 depositions and transcribed interviews.
Meta CEO Mark Zuckerberg had told lawmakers that senior Biden administration officials repeatedly pressured Facebook to remove certain COVID-19 content and that the company should have resisted more strongly.
The Dallas Express has repeatedly examined the censorship issue, including Zuckerberg’s admission and subsequent changes at Meta. The scrutiny helped change company policies and federal practices, but those results did not translate into criminal convictions of senior White House officials.
The Russia Investigation Shows A Different Kind Of Gap
Special Counsel John Durham’s review of the FBI’s 2016 Trump-Russia investigation illustrates another outcome: serious institutional criticism with little criminal punishment.
Durham concluded that the FBI opened Crossfire Hurricane without taking several basic investigative steps and criticized what he described as confirmation bias and disparate treatment.
His office obtained one guilty plea from former FBI lawyer Kevin Clinesmith for altering an email used in a surveillance application. A judge sentenced Clinesmith to probation. Juries acquitted the two other defendants Durham brought to trial.
Convictions Can Also End With Clemency
The Biden family investigations produced yet another version of the accountability gap.
House Republicans released an impeachment inquiry report in August 2024 accusing then-President Joe Biden of impeachable conduct tied to his family’s business dealings. The House never voted to impeach Biden before he left office. Separately, federal prosecutors secured felony convictions against Hunter Biden in gun and tax cases.
Those convictions did not lead to a sentence.
Biden issued his son a full and unconditional pardon on December 1, 2024, covering federal offenses Hunter Biden committed or may have committed from January 1, 2014, through the date of the pardon. The President later issued preemptive pardons to several other family members.
Presidential clemency sits squarely within Article II of the Constitution. It also demonstrates why a criminal conviction does not always end with punishment.
Epstein Shows Why ‘No Accountability’ Can Overstate The Case
The Epstein files illustrate the need for another distinction.
Jeffrey Epstein died in federal custody in 2019 before he could stand trial on federal sex-trafficking charges. Ghislaine Maxwell did face a jury, received a conviction and is serving a 20-year federal prison sentence.
What remains unresolved for many Americans is whether prosecutors fully investigated or charged other people who may have participated in crimes. DOJ said in January that it had released nearly 3.5 million pages under the Epstein Files Transparency Act, including more than 2,000 videos and 180,000 images. A prior DOJ-FBI review said investigators found no evidence that would support opening cases against uncharged third parties.
The enormous document release may answer some questions. It does not guarantee additional prosecutions.
A Report Is Not A Conviction
Not every high-profile investigation that ends without prison demonstrates corruption or favoritism. Prosecutors must prove each element of a crime beyond a reasonable doubt. Witnesses can invoke constitutional rights. Juries can acquit. Statutes of limitation can expire. Courts can reject legal theories. Presidents can pardon federal offenses.
The Hillary Clinton email investigation offers a useful caution. The Justice Department inspector general sharply criticized FBI conduct and identified inappropriate political messages among employees, but the inspector general also said investigators found no evidence that political bias affected prosecutors’ ultimate decision not to charge Clinton.
That distinction should apply across party lines. A hearing can reveal conduct that voters find unacceptable without establishing a crime. A referral can identify evidence worth examining without proving guilt. And a report can document institutional failure without identifying a person whom prosecutors can lawfully imprison.
The Accountability Question Remains
Still, repeated investigations can erode public trust when agencies document failures, but Americans see few personal consequences at the top.
Congress wrote thousands of pages on government censorship. COVID investigators reviewed more than one million pages. DOJ published nearly 3.5 million pages from the Epstein files. The OCC reviewed 420,000 pages on debanking. Durham spent years examining the origins and conduct of the Trump-Russia investigation.
The American system intentionally divides power among Congress, prosecutors, courts and the presidency. That protects citizens from a legislature that can investigate, prosecute and imprison its enemies by itself. The same separation can also leave voters watching one branch expose conduct while another branch declines to punish it.
That tension leaves the central question unresolved: whether the system can produce consequences proportionate to documented misconduct regardless of a person’s political connections, institutional power or public profile.
The volume of paper is not the same thing as justice.
