Dallas (WBAP/KLIF) – A Dallas judge has dismissed an open records lawsuit filed against the State Fair of Texas.
The lawsuit was filed by an Austin law firm on the grounds that the State Fair is actually a governmental body, and is therefore subject to Texas’ public information laws.
However, Judge Tonya Parker ruled the State Fair is what it claims to be, a non-profit that runs the fair through a contract with the city of Dallas.
As part of the ruling the Austin law firm is to pay the State Fair’s legal expenses of a little more than $200,000, and the State Fair keeps its non-profit status. The Austin law firm says it will appeal.
