Texas Supreme Court Orders Dallas Salon Owner’s Release from Jail

DALLAS (WBAP/KLIF) – The Dallas salon owner jailed this week after violating state and local coronavirus restrictions was released from jail on Thursday after the Texas Supreme Court became involved.

Shelley Luther walked out of the Dallas County jail to an uproar from supporters.

“I just want to thankful all of you who I just barely met and near we’re friends,” Luther said. “You mean so much to me and this would have meant nothing without you.”

Luther spent close 48 hours in jail after violating a Judge’s restraining order to close Salon A La Mode. She was jailed for being in contempt of court. The Texas Supreme Court ordered her release Thursday morning.

“Sometimes when people file these things it’s a Hail Mary,” said Luther’s Attorney, Warren Norred. “It’s not a Hail Mary. This was a valid complaint.”

 

Norred said no bond was ever posted on the TRO by the City of Dallas.

“Without a bond you don’t have an enforceable injunction ,” Without an enforceable injunction you don’t have contempt.”

Luther is out of jail in time to be a part of Salon A La Mode’s legal opening Friday, as salons can open statewide.

Governor Abbott called Luther’s jailing “excessive.”

Luther’s attorney says she will continue to take up her legal matter with the city.
