DALLAS (WBAP/KLIF) – The woman seen on cell phone video being repeatedly punched by a Deep Ellum bartender is facing a felony charge in the case.
The Dallas Police Department said Tuesday that L’Daijohnique Lee broke the windows on Austin Shuffield’s truck after the attack. The estimated damage caused to the truck was higher than $3,000. In Texas, criminal mischief is a state jail felony if the damage costs over $2,500 to $30,000.
“It’s not the intention of the Dallas Police Department to pick one side or the other,” said Deputy Chief Thomas Castro. “We simply had information on a criminal offense and we investigated it and took action.”
Shuffield is facing multiple charges in the case, including a felony Aggravated Assault with a Deadly Weapon charge that DPD referred to the Dallas County District Attorney’s Office. Shuffield was armed with a gun he did not have a license for the night of the attack.
Activists are angered by the charge against Lee.
“A black woman is alone in a dark parking lot is stalked, harassed, and assaulted by a white male,” wrote Lee’s attorney, Lee Merritt on Twitter. “He brandishes a gun, knocks away her phone when she tries to call for help, then beats her mercilessly with blows to the head. DPD just found a way to charge her with a felony.”
Protests are planned for Wednesday morning at Dallas City Hall.
